1. Create a Shared Calendar
💻 Digital Solution: Use a shared digital calendar that both parents and the child can access. This calendar can include school events 🎵🎭, extracurricular activities ⚽, and family plans.

📅Physical Calendar: For younger kids, a physical calendar with color-coded days can help them visualize which days they’ll spend at each home.

2. Maintain Consistent Routines
⏰Establish similar daily routines at both homes for activities like homework 📝, bedtime 🛏️, and meals 🍽️. This consistency helps the child know what to expect and reduces stress.
📞Make sure both parents communicate about any changes in routine to keep things synchronized.

3. Create Travel Packs
🛄Prepare a travel pack with essentials that move with the child between homes. This can include school supplies, favorite toys, or comfort items like a blanket or stuffed animal.
2️⃣Consider having duplicates of necessary items (toothbrush 🪥, pajamas, etc.) at both homes to minimize forgotten items and reduce stress during transitions.

4. Develop a Packing Checklist

Flowers🌹. Butterflies🦋. Decorated skulls💀. To celebrate the Day of the Dead, people visit graves 🪦 and prepare food, drink and flowers for the deceased. It’s a day when families honour their dead relatives with happiness & respect. There is a belief the ancestors return for a brief visit with family and to receive gifts. Death is not to be feared; it’s a part of life.

What does the Day of the Dead have to do with Family Law? Just that it made us think of inheritances.

In a Family Law context, we may receive gifts from the living or deceased loved ones may leave us inheritances. These gifts provoke interesting discussions for divorcing parties as to whether the amounts are excluded from property division.

Generally, married spouses are entitled to a division of property with some exceptions. One of the classes of assets that may not be shared is property, other than a matrimonial home, that was acquired by gift or inheritance from a third person after the date of marriage.

Where a married person receives an inheritance and that inheritance is still owned at the time of separation or death, they are not required to share its value and it is therefore excluded property.

There are of course exceptions to the rule. For example, if a family home at the time of marriage breakdown is inherited or gifted, its value will be divided with the other spouse. Similarly, if money received as an inheritance or gift is invested in a matrimonial home, the recipient will not be permitted to exclude the value.

So many rules, caveats and exceptions to the rules! We aren’t shy about using the collaborative process to design agreements that fit the clients’ goals when the legal model does not lead to their desired outcome.
